仅在公司需要向您提供产品或服务，或为履行公司法律职责或者义务，及/或我们已获得您的同意处理这些信息时，才会处理这些信息。

我们可能会直接从您处收集您的个人信息，或从多种渠道收集，包括：

We may collect and process personal information relating to representatives of institutional investors (including legal representatives, beneficial owners and authorised representatives) and individual investors (where applicable), including:

• Information about your identity for identification and security purposes, such as your full name, date of birth, gender, marital status, country of birth, identification document number, nationality, passport number, expiry date and place of issue, occupation and employment details, including position, salary and employer address
• Information that allows us to contact you, such as your residential address, correspondence address, postal code, telephone number (including landline and mobile numbers), and email address
• Information required for compliance reviews, identity verification, anti-money laundering checks and client management prior to providing products or investment services. This may include details relating to institutional investors' legal representatives, beneficial owners and authorised representatives, including their names, contact details (including personal telephone numbers and email addresses), nationality, date of birth, gender, habitual residence or business address, identification document type, identification document number, identification document validity period and position

• Information collected to support business development activities, institutional partnerships and client relationship management across the Asia-Pacific region (including China), including the names, gender, telephone numbers, email addresses and positions of representatives of prospective and existing institutional clients
• Information about your contact with us, such as meetings, telephone conversations, emails and correspondence
• Information that is automatically collected when you visit our websites, including through cookies and similar technologies
• Information about people connected to you where required to provide the agreed product or service, such as the name, date of birth, nationality, national identification number or passport number of a spouse or beneficiary
• Information classified as "Sensitive Personal Information" under applicable law, including, where applicable, habitual residence information, identification document numbers and copies, residential and correspondence addresses, asset information, income information, credit information, integrity records and financial account information

This information will only be collected and processed where it is necessary to provide products or services to you, fulfil our legal and regulatory obligations, and/or where we have obtained your consent to process such information.

If you have a distributor / broker / agent, the information we collect, and use will most likely have been provided by them on your behalf. 

We take your privacy seriously and we will only ever collect and use your information where it is necessary and lawful to do so. We will collect and use your information only when we can satisfy one of the lawful processing conditions set out under the Personal Information Protection Law of the People's Republic of China ("PIPL") and other applicable laws and regulations.

This will be the case where: 

• It is necessary to provide the product or service you have requested, e.g. if you wish to invest in one of our funds or products, we will require some personal information, which may include your name, address, date of birth and bank account details
• It is necessary for us to meet our legal or regulatory obligations, e.g. to send you Annual Statements, inform you about changes to our Terms and Conditions or for the detection and prevention of fraud
• It is necessary for our legitimate interests, provided that such interests do not override your rights and interests as a data subject, for example, to develop new products and services for our clients, in accordance with applicable laws and regulations
• It is necessary for the performance of a task, we need to perform in the public interest
• It is necessary to support business development activities, institutional partnerships and client relationship management across the Asia-Pacific region (including China), including initial engagement with prospective partner institutions and ongoing communication with existing institutional clients. You provide your explicit consent for us to use your personal information for agreed purposes when you voluntarily provide such information in connection with a product or service you have requested. Subject to the above, we may use your personal information for the following purposes:

You may be required to provide the personal information that we or our service providers process on our behalf, as described above. The Sensitive Personal Information described in the section "Information We Collect and Use" is necessary for the management of fund investment activities, including investor suitability assessments, transaction execution, tax reporting, compliance reviews and the provision of client services. If you do not provide such Sensitive Personal Information, we may be unable to carry out certain activities required under applicable laws and regulations, including investor suitability assessments, and may therefore be unable to provide you with products or services.

Compared with other categories of personal information, Sensitive Personal Information may have a greater impact on your rights and interests. Unauthorised disclosure, misuse or improper processing of Sensitive Personal Information may result in harm to your personal safety, financial security or personal dignity. We therefore encourage you to carefully consider whether to provide Sensitive Personal Information to us.

Before providing such information, please ensure that you have read and understood the information relating to Sensitive Personal Information set out in this Privacy Notice. If you do not wish us to process your Sensitive Personal Information, please do not provide such information to us.

We may share your personal information with third parties we work with for the purposes outlined in ‘Why we collect and use your information’.

We will only disclose your Personal Information to such third parties where it is lawful and in line with our obligations under data protection laws.

We will share your information with:

• Other entities that support us in providing products or services to you, including subsidiaries (abrdn Asia Limited and abrdn Hong Kong Limited), holding companies, related corporations and affiliated companies, whether existing now or in the future
• Companies and partners carefully selected to support our operations, whether within or outside of China

• Your distributor/broker/agent, where relevant to the products or services you have agreed with us
• Our regulator, including the China Securities Regulatory Commission (CSRC), the Cyberspace Administration of China (CAC) and other relevant regulatory authorities
• Designated government authorities, public authorities and organisations responsible for overseeing the provision of services
• Law enforcement and other designated authorities that assist us, or that request personal information from us, for the prevention, detection or investigation of crime, as well as the State Taxation Administration (STA) where necessary for tax reporting purpose
• Other third parties where required in connection with a corporate reorganisation, amalgamation, merger, division or sale

We will share your information with the following parties (for information regarding the cross-border transfer of personal information, please refer to the section "Cross-Border Transfers of Personal Information" below):

When disclosing your personal information to these third parties, we will take appropriate measures to ensure that they keep your personal information confidential and do not use it for any purpose beyond the scope authorised by us.

We will only appoint a third party to process personal information on our behalf where we have obtained sufficient assurances that they will manage and protect your personal information in accordance with applicable legal and regulatory requirements.

In addition, before providing or disclosing personal information to such service providers, we require them, through written contracts or equivalent arrangements, to process personal information strictly in accordance with our instructions and agreed terms of use, including implementing appropriate measures to protect and properly handle personal information.

We periodically review and verify their ongoing compliance with these obligations.

In the course of carrying out the processing purposes described in the section "Why We Collect and Use Your Information", we may, where necessary, provide the personal information of representatives of institutional investors and individual investors (where applicable) to overseas recipients.

In relation to such cross-border transfers of personal information, and in accordance with applicable laws and regulations, we will inform the relevant institutional investors and individual investors (where applicable) of matters relating to the overseas recipient, including:

• The name of the overseas recipient;
• Contact details of the overseas recipient;
• The purpose of processing;
• The method of processing;
• The categories of personal information to be transferred; and
• The methods and procedures by which individuals may exercise their rights under applicable laws and regulations in relation to the overseas recipient.

Where required by applicable laws and regulations, we will obtain the individual's separate consent before transferring their personal information to an overseas recipient.

The majority of your personal information is processed in China.

However, some of your personal information may be processed by us or the third parties we work with outside of China.

Where your personal information is transferred outside of China, we will take additional measures to ensure that such transfers comply with the Personal Information Protection Law of the People's Republic of China (PIPL).

For information regarding cross-border transfers of personal information, please refer to the section "Cross-Border Transfer of Personal Information" above.

We take personal information and security very seriously and we strive to comply with our obligations at all times. Any personal information which is collected, recorded or used in any way, whether on paper, online or any other media, will have appropriate safeguards applied in line with our data protection obligations. 

Your information is protected by controls designed to minimise loss or damage through accident, negligence or deliberate actions. Our security controls are aligned to industry standards and good practice; providing a control environment that effectively manages risks to the confidentiality, integrity and availability of your information whether it is being processed by us or a third party acting on our behalf.

Our employees also protect sensitive or confidential information when storing or transmitting information electronically and are required to undertake annual training on information security and data protection.

We engage internal and external audit functions, as well as specialist third-party consultants, to conduct regular independent assurance reviews and benchmarking exercises to assess the effectiveness of our security control environment and overall security strategy.

In the event of a personal data breach, we will assess whether it is notifiable under the Personal Information Protection Law of the People’s Republic of China (PIPL). Where required, we will notify the relevant authorities and affected individuals as soon as practicable and in line with applicable legal requirements.

To provide products or investment services to you, to achieve the processing purposes described in the section "Why We Collect and Use Your Information", and to comply with our legal and regulatory obligations, we retain your personal information and copies of records we create (for example, records of calls with us) while you are a prospective client, client or investor.

Even after your relationship with us has ended, we may be required to retain certain information for legal and regulatory purposes. The retention period applicable to different categories of personal information may vary depending on the retention period prescribed under applicable laws and regulations or the minimum period necessary for the relevant processing purpose.

We regularly review our retention periods to ensure compliance with all applicable laws and regulations.

 You have a number of rights under PIPL data protection laws, which may be exercised in certain circumstances.

a. Right to be Informed

You will be informed of the purposes for which your personal information is processed at or before the time of collection. We do this through this Privacy Notice and, where appropriate, through other product and service-related documents.

Unless otherwise provided by applicable laws and regulations, you have the right to be informed about and decide upon the processing of your personal information, and the right to restrict or refuse the processing of your personal information by others.

b. Right to Withdraw Consent

You have the right to withdraw any consent that you have provided, or are deemed to have provided, in relation to the collection, use or disclosure of your personal information at any time.

We will process your request within a reasonable period of time.

c. Right of Access and Correction

Unless otherwise provided by applicable laws and regulations, you have the right to request access to and obtain a copy of your personal information.

e. Right to Refuse or Restrict Processing

You have the right, in certain circumstances and subject to applicable legal requirements, to restrict or object to the processing of your personal information.

f. Right to Erasure 

You have the right to request the deletion of your personal information.

We will process your request within a reasonable period of time. However, please note that where the retention period required by laws or administrative regulations has not expired, or where deletion is technically difficult to achieve, we may retain the relevant personal information but will cease any processing activities other than storage and the implementation of necessary security measures.
