We may collect and use personal information, including:

• Information about your identity for identification and security purposes, such as your full name, date of birth, gender, marital status, country of birth, national identification number, nationality, passport number, expiry date and place of issue, occupation and employment details, including position, salary, and employer address
• Information that allows us to contact you, e.g. address (current address in China and registered home address if different), telephone (mobile) number, email address
• Information connected to your products or services, e.g. bank account details
• Information about your contact with us, e.g. meetings, phone calls, emails/letters
• Information that is automatically collected e.g. via cookies when you visit one of our websites
• Information about people connected to you, where required to provide the agreed product or service e.g. name, date of birth, nationality, national ID number or passport number of your spouse or beneficial owner
• Information classified as ‘sensitive’ personal information e.g. relating to your health or gender
• Information you provide when sharing your contact details at events, conferences, meetings, or other professional engagements (e.g. through business cards or event registration forms)

This information will only be collected and used where it’s required to provide the product or service you have with us, or to comply with our legal obligations, and where we have also obtained your consent to process this information.

We may collect your personal information directly from you, or from a variety of sources, including:

• An application form for a product or service
• Phone conversations with us
• Emails or letters you send to us
• Meetings with one of our business development or relationship managers
• Registering for one of our events
• Participating in research surveys to help us understand you better and improve our products and services
• Attachments you open with newsletters that are sent to you electronically
• External third parties who support us in verifying your identity and relationships with our corporate clients

We may also collect personal information about you from places such as business directories and other commercially or publicly available sources e.g. to check or improve the information we hold (like your address) or to obtain updated contact information if we are unable to contact you directly. 

If you have a distributor / broker / agent, the information we collect, and use will most likely have been provided by them on your behalf. 

We take your privacy seriously and we will only ever collect and use your information where it is necessary and lawful to do so. We will collect and use your information only when we can satisfy one of the lawful processing conditions set out in the data protection laws. This will be the case where: 

• Where it’s necessary to provide the product or service you have requested, e.g. if you wish to invest in one of our funds or products, we will require some personal information, which may include your name, address, date of birth and bank account details
• Where it’s necessary for us to meet our legal or regulatory obligations, e.g. to send you Annual Statements, inform you about changes to our Terms and Conditions or for the detection and prevention of fraud
• For our legitimate interests where such interests do not override yours as the data subject, e.g. to develop new products and services for our customers
• For the performance of a task, we need to perform in the public interest
• If you are a prospective client or contact, we may use your information to follow up on your interest in our services, send you relevant updates, or invite you to future events, in accordance with China’s data protection laws

You have given us your explicit consent to use your personal information for an agreed purpose when you voluntarily provide your personal information as part of providing a product or service you have requested. You may withdraw consent at any time by giving reasonable notice via the contact details included under “How to contact us”.

Subject to the above provisions, we may use your personal information for the following purposes:

• Account opening, including information verification and credit checks
• Instruction Processing
• Fund Allocation
• Legal and Compliance Reporting
• Marketing and Research, including analysis and promotion
• Call Handling (Incoming and Outgoing)

You will be required to provide the personal information as required to be processed by or on behalf of us, as described above. If you do not agree to provide such personal information to us in accordance with this Notice, we may not be able to provide you with the product(s) or service(s) requested or comply with any of our contractual obligations owing to Customers.

We may share your personal information with third parties we work with for the purposes outlined in ‘Why we collect and use your information’.

We will only disclose your Personal Information to such third parties where it is lawful and in line with our obligations under data protection laws.

We will share your information with:

• Other parts [subsidiaries, holding companies, related corporations or associates of ours whether present or future] of Aberdeen Group plc who support us in the provision of the product or service you have
• Companies and partners, we have carefully chosen to support us, both inside and outside of China
• Credit reference agencies for the purpose of conducting credit checks and identity verification
• Your distributor/broker/agent as part of a product or service you have agreed with us
• Our regulator, including the China Securities Regulatory Commission, Cyberspace Administration of China (CAC) and other relevant regulators
• The designated government agency, public agency, agency who is responsible for overseeing the provision of services
• Law enforcement and other appointed agencies who support us (or where they request the personal information) in the prevention and detection of crime, and State Taxation Administration (STA) for the purposes of tax reporting where necessary
• Other third parties where required to support the organisation restructure, amalgamation, merger or sale

By disclosing your personal information to such third parties we shall ensure that those persons shall treat your Personal Information confidentially and shall not use such information for any purposes other than within the scope specified by us.

We will only instruct a third party to process your personal information on our behalf where we have obtained the necessary assurance that they will properly manage and protect your information to the required standards under applicable laws. 

Moreover, before we provide and disclose your personal information to such service providers we require, by way of a written contract or similar means, assurance they will process this data strictly in compliance with our instructions and agreed terms of use including appropriate measures to properly handle personal information. We periodically verify their ongoing compliance with these obligations.

The majority of your personal information is processed in China.

However, some of your personal information may be processed by us or the third parties we work with outside of China.

When your personal information is transferred outside of China, we will take additional measures to ensure it complies with the Personal Information Protection Law of the People's Republic of China (PIPL).

We take personal information and security very seriously and we strive to comply with our obligations at all times. Any personal information which is collected, recorded or used in any way, whether on paper, online or any other media, will have appropriate safeguards applied in line with our data protection obligations. 

Your information is protected by controls designed to minimise loss or damage through accident, negligence or deliberate actions. Our security controls are aligned to industry standards and good practice; providing a control environment that effectively manages risks to the confidentiality, integrity and availability of your information whether it is being processed by us or a third party acting on our behalf.

Our colleagues also protect sensitive or confidential information when storing or transmitting information electronically and must undertake annual training on this.

We also use internal and external audit and specialist third party consultants to conduct regular, independent assurance and benchmarking exercises across our business to ascertain the effectiveness of our security control environment and our security strategy.

In the event of a personal data breach, we will assess whether it is notifiable under the PIPL. Where required, we will notify the relevant authorities and affected individuals as soon as practicable and in line with applicable legal requirements. 

To provide your product or investment, and meet our legal and regulatory obligations, we keep your personal information and copies of records we create (e.g. calls with us) while you are a [prospective] client or investor.

Even when you no longer have a relationship with us, we are required to keep information for different legal and regulatory reasons. The length of time will vary, and we regularly review our retention periods to make sure they comply with all laws and regulations.

You have a number of rights under PIPL data protection laws, which may be exercised in certain circumstances. 

These include:

1. Right to be Informed
   You shall be informed of the purposes for collection, use or disclosure of your personal information, on or before collecting your personal information. We do this by way of our Privacy Notice on our website and included within various other product and service-related documents, as appropriate.
2. Right to Withdraw Consent
   You have the right to withdraw any consent given or deemed to have been given in connection with the collection, use or disclosure of your personal information under the Personal Information Protection Law at any time. We will then process your request within a reasonable timeframe.
3. Right of Access and Correction
   Individuals have the right to access and obtain a copy of their personal information upon request. You may request that any errors or omissions related to your personal information be corrected or supplemented. We will then process your request within a reasonable timeframe.
4. Rights to Transfer
   Individuals have the right to request the transfer of their personal information to their designated personal information processor if their request meets the conditions set forth by the CAC. We will then process your request within a reasonable timeframe.
5. Right to Refuse or Restrict Processing
   Individuals have the right to restrict and refuse the processing of their personal information in certain circumstances, subject to applicable legal requirements. 
6. Right to Erasure
   Upon request of erasure of individual’s personal information, we will process your request within a reasonable time.
7. Right to Explanation 
   You may request an explanation of how we process your personal information, including the rules governing such processing and, where applicable, decisions made in relation to your personal information.
8. Rights in Relation to Automated Decision-Making
   Where we use automated decision-making that may significantly affect your rights and interests, you may request an explanation of the decision-making process and object to decisions made solely through automated processing, where permitted by applicable law.
9. Right to Data Portability
   Subject to applicable legal requirements, including conditions prescribed by the Cyberspace Administration of China (CAC), you may request the transfer of your personal information to another personal information processor.
